These Terms and Conditions ("Terms") govern your access to and use of any Edushift mobile application (each, the "App," and collectively, the "Apps") provided by The Digital Shift ("we," "us," or "our") — including our exam preparation apps for professional certifications such as CAPM®, PMP®, PMI-RMP®, and PgMP®. These same Terms apply to every App we publish, current and future. By downloading, installing, or using any App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you confirm that:
- You are at least 13 years of age (or the applicable minimum age in your jurisdiction).
- You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
- If using the App on behalf of an organization, you have authority to bind that organization.
2. Description of the Apps
Each Edushift App helps users prepare for a professional certification examination. Depending on the App, features include:
- Practice questions and mock exams
- Flashcards and study materials
- AI-powered study assistance and chat
- Performance analytics and progress tracking
- Daily quizzes and study streaks
- Subscription-based access to full question banks and premium features
3. User Accounts
3.1 Account Creation
You may use the App as a guest or sign in using Google or Apple. By signing in, you authorize us to access basic profile information from that provider.
3.2 Account Responsibility
- Provide accurate and current information.
- Notify us at contact@thedigitalshift.co of any unauthorized account access.
- Do not share credentials or allow others to access your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms.
4. Subscriptions and In-App Purchases
4.1 Free and Premium Access
The App offers a free tier and premium subscription plans that unlock the full question bank and additional features.
4.2 Subscription Billing
- Billed through Google Play Store or Apple App Store. All billing is governed by the applicable store's policies.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
4.3 Cancellations and Refunds
- Cancel through your store account settings. Access continues until end of billing period.
- Refunds are subject to the relevant store's refund policy. We cannot process refunds directly.
4.4 Price Changes
We may change pricing. You will be notified before your next billing cycle.
4.5 Free Trials
If offered, free trials convert to paid subscriptions upon expiration unless cancelled beforehand.
5. Intellectual Property
5.1 Our Content
All content — questions, explanations, flashcards, AI responses, logos, and code — is the exclusive property of The Digital Shift or its licensors.
5.2 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial study purposes only.
5.3 Restrictions
- Copy, reproduce, distribute, or sell any App content.
- Modify, adapt, or reverse engineer any part of the App.
- Use automated data-gathering methods on the App.
- Use the App to create a competing product.
6. Acceptable Use
You agree not to:
- Use the App for any fraudulent, illegal, or unauthorized purpose.
- Attempt to gain unauthorized access to any portion of the App or its servers.
- Interfere with or disrupt the App's integrity or performance.
- Upload or transmit harmful code, viruses, or malicious software.
- Impersonate any person or entity.
- Share, sell, or transfer your account or subscription to any third party.
7. AI-Powered Features
By using the AI study assistant, you acknowledge that:
- AI-generated responses are for educational guidance only and may not always be accurate.
- We do not warrant the accuracy or completeness of AI-generated content.
- Always verify information with authoritative sources.
- Your interactions may be used in aggregated, anonymized form to improve the service.
8. Disclaimers
8.1 No Affiliation with PMI
Our Apps are independent and not affiliated with or endorsed by PMI® or any other certification body. PMI®, CAPM®, PMP®, PMI-RMP®, and PgMP® are registered trademarks of the Project Management Institute, Inc.
8.2 No Guarantee of Exam Success
We make no warranty that use of the App will result in passing any exam. Results depend on individual effort and preparation.

You agree to defend, indemnify, and hold harmless The Digital Shift and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
11. Third-Party Services
The App integrates third-party services (Google, Apple, Firebase). These are governed by their own terms and privacy policies. We are not responsible for their practices.
12. Modifications
We may modify, suspend, or discontinue the App or revise these Terms at any time. Material changes will be communicated via in-app notice. Continued use constitutes acceptance.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Disputes will first be resolved through good-faith negotiation; if unresolved within 30 days, they are subject to the exclusive jurisdiction of courts in Jodhpur, India.
EEA/UK consumers may also use alternative dispute resolution (ADR) mechanisms.
14. Severability
If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary or severed. Remaining provisions continue in full force.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Digital Shift regarding your use of the App.
